Claudia Khoo: A Rising Star in Banking and Finance Litigation
Claudia Khoo is a partner at Shook Lin & Bok Singapore, one of the leading law firms in Singapore. Acting for foreign trustees in successfully registering a Malaysian judgment in Singapore for RM65 million and interest against a former major player in the Singapore real estate industry and successfully defending against the application to set aside the registration in the High Court of Singapore and before the Appellate Division. The case involved the legal interpretations of the meaning of âappealâ in the Reciprocal Enforcement of Commonwealth Act and the definition of âappealâ in the Reciprocal Enforcement of Foreign Judgments Act as well as the scope of registration of foreign judgments in Singapore;
Acting for a foreign financial institution in respect of a claim of undue influence by a debtor in attempting to set aside the foreign financial institutionâs security documentation and successfully obtaining judgment against the debtor;
Acting for a local financial institution in respect of a discovery application in relation to bankersâ books. This case concerns the Courtâs detailed analysis of what constitutes bankersâ books under Part IV of the Evidence Act and under the Banking Act in respect of banking secrecy. The Court considered for the first time that account opening documents do not fall within the definition of bankersâ books;
Successfully acting for a local financial institution in a high profile matter in obtaining summary judgment against a customer who disputed the claim on inter alia, the grounds that the customer had been defrauded of the moneys claimed by the local financial institution and that the local financial institution had breached their duties of care to the customer, and facilitating the full recovery of all outstanding amounts due and owing by the customer.
